Types of solicitor certification

The type of solicitor certification required depends on the nature of the document and how it will be used.

  • Certified copy
The solicitor confirms that a copy of the document is a true and accurate copy of the original.
  • Certified original
The solicitor certifies the authenticity of the original document, confirming it is genuine.
  • Signature witnessing
The solicitor confirms that they personally witnessed the document being signed. This is usually indicated by wording such as “signed in my presence” or “witnessed by”.

Certification Requirements for Apostille
For documents intended for Apostille legalisation, certification must meet specific requirements:

  • The solicitor must sign using their own name, not the firm’s name
  • The date of certification must be clearly stated
  • The certification wording must be appropriate to the document type and intended use

Incorrect or incomplete certification can lead to delays or the need for re-submission when documents are reviewed by the FCDO.

When Is solicitor certification required?

When applying for a UK Apostille, some documents must first be certified by a UK solicitor before they can be accepted by the Foreign, Commonwealth & Development Office (FCDO).
Solicitor certification confirms that a document is genuine and properly prepared, allowing the FCDO to verify the solicitor’s signature and proceed with legalisation. This step ensures the document meets UK legalisation standards and can be recognised for official use abroad.

If a document that requires solicitor certification is submitted without it, the application may be delayed or returned for correction.

Documents That Commonly Require Solicitor Certification
Certain documents are not issued or signed by a recognised UK public authority and therefore require solicitor certification before Apostille.
These commonly include:

  • Company registration documents and commercial contracts
  • Academic certificates, diplomas, and transcripts
  • Personal legal documents such as powers of attorney and affidavits

When is solicitor certification NOT required?

Solicitor certification is usually not required when a document has already been issued or signed by a recognised UK public authority and contains an original signature or official stamp.
In these cases, the document can normally be submitted directly for Apostille legalisation without any additional solicitor involvement.

Common examples include:

  • UK birth and marriage certificates
  • Court-issued documents
  • HMRC letters and official tax documents

Important notice – FCDO signature verification

If your documents have been certified by a UK solicitor or Notary Public, please ensure that the certifier’s signature is recognised by the Foreign, Commonwealth & Development Office (FCDO).

You can usually confirm this directly with the solicitor or notary who completed the certification.

If the signature has not yet been registered, we can assist with the FCDO signature verification and registration process. Contact our team by phone or email, and we will be happy to help prevent any delays.
